Well this is good news:
SAVANNAH, Ga. – A soldier who refused to go to Iraq will be court-martialed for accepting unearned combat pay, despite an Army investigator’s conclusion that an accounting error was to blame.
Larceny charges were added against Sgt. Kevin Benderman, 40, who was already awaiting trial on charges that included desertion. The larceny charges raise the possible penalty from seven years to 17. A trial date has not been set.
“It’s an outrage,” Benderman’s attorney William Cassara said Tuesday. “They said up to 100 soldiers at Fort Stewart received that money improperly, and he’s the only one facing any disciplinary action.”
Benderman, an Army mechanic, refused to go to Iraq with his 3rd Infantry Division unit for a second tour of duty Jan. 8, days after he told commanders he was seeking a discharge as a conscientious objector.
While Benderman remained at Fort Stewart, prosecutors say, he accepted $2,922 in bonuses and tax breaks for soldiers serving in combat zones. The combat pay stopped after his unit commanders noticed in April.

Accounting error or not this idiot knew what he was receiving wasn’t earned, cashed the checks, possibly sent a donation to International ANSWER and other moonbat “peace” organizations and now his shyster is using the other people were doing it defense as if he were a ten year old in a playground dispute.
Tough asshole! The prosecutors wouldn’t be playing a game of legal dog pile if Benderman hadn’t placed himself in this position in the first place. As far as I’m concerned the army can give him a Koran and a one way ticket to Gitmo.
Interesting enough I received an Email from Benderman about three weeks ago. Someone proped him up before a computer apparently and he Googled this post I wrote in January. It gives in exqusite detail just how duplicitous this bastard is using quotes from a letter he posted at the Project for the Old American Century website. (see full letter here) In short, he has enlisted in the army three times, the third time after the alleged atrocities he witnessed that caused him to refuse another deployment to Iraq and seek a discharge as a conscientious objector.
Here is a portion of the Email Benderman sent me:
Anyway, I noticed that you talk about my points on the money spent on wars could be used for more itelligent uses as being in pollyannaville. My question to you is this; Why do you think it is stupid to say that we could have all the things I described with the amount of funds that we waste on wars. I do not have the amounts for all the wars that we have fought but the current one is at 300 billion and counting, which to give one example, would pay for about 16 million four year scholarships at the upper level universities in the country.
I feel that to be a better use of money, educating our young men and women istead of getting them killed in war. And I believe that for all people here even you and your children. You say that you are a 20 year veteran and I can imagnine in those 20 years that you have seen some of the stuff I talked about, so what about that makes you want to give that opprtunity to your kids and grandkids? I don’t want mine, yours, or anyone else’s children to have to see what you and I have as a result of war and I do not really think that you do either.
Below I have pasted the paragraph of what I could think would be a better spenditure of our funds, so if you would, I would ask you to give me your reasons for saying that war is better than taking care of some of those concerns that we have a nation.
“I would presume that we as a nation would be out of debt if we were to apply as much energy to pursuing sound economics as we do pursuing war, we would never get sick if we spent as much on preventive medicine as we do on war, the elderly would get affordable prescription medication if we were to use the resources that are spent on war to work for that purpose, there would not be UN educated children if we were to buy new classrooms and books for schools instead of new weapons systems, social security would be a lot more secure with some of the money that war costs.”
I would appreciate the response and I respect your right to opinion and your life to be free from the people that would not give you the freedom to express what is best for you, all I ask is the same in return.

I won’t bore you with my response other than to say I corrected his wildly over inflated Iraq war cost and noted he had enlisted the third time after the “horrors of war” he had witnessed. Surpisingly enough he answered that mail despite the fact I called him a chicken shit bastard and to politely fuck off.
I banned his IP and Email addy from my mail proxy and… well gee, I have been moonbat free ever sense.
